The largest union at South African state-owned electric provider Eskom, ICEM-affiliated National Union of Mineworkers (NUM), has threatened national strike action if demands on housing allowances and promoting temporary workers to full-time positions are not met. 
 
The NUM engaged in marches and manifestations at Eskom facilities in three provinces last week, and a 16 February central march was undertaken by the union to present a petition of the demands to Eskom management at its at its Klerksdorp headquarters in Matlosana, North West province.

Those demands include delays in the finalization of housing allowances, deferred from last summer&rsquo;s collective negotiations; the banning of labour brokers and absorbing temporary workers onto full-time employment rolls; and opposition to the higher, proposed electricity tariffs of 35% in each of the next three years. 
 
&ldquo;We cannot have a situation in which some labour brokers are still around to exploit our members,&rdquo; said NUM Regional Coordinator Eldris Mphahlete, who also expressed his displeasure that the housing allowance issue is still unresolved. &ldquo;Strike action is on the horizon,&rdquo; he added.

The Congress of South African Unions (COSATU), and its regional branches are supporting the NUM in its demands. The NUM represents some 16,000 of Eskom&rsquo;s 28,000 employees in South Africa. 
 
Also last week, the NUM began an indefinite strike at Idwala Lime, a sodium carbonates and industrial materials business owned by Black Economic Empowerment company Tiso Group and private equity entities Ethos and Old Mutual. Operations are located near Danielskuil, Northern Cape province. A vast majority of the 300 workers have selected the NUM as bargaining representative, but management has refused formal recognition despite prolonged dialogue. NUM Regional Organizer Botshelo Lebelo said Idwala Lime is &ldquo;opting for a confrontational approach&rdquo; to labour-management relations.

Housing Allowances, Labour Brokers Bring NUM to Edge of Strike at Eskom

German union IG Metall and the employers&rsquo; federation Gesamtmetall set the tone inside Germany for 2010-2011 bargaining when the two sides came to an early and enlightened accord on a pair of collective agreements covering 700,000 metal and electronics workers in North Rhine-Westphalia state. The agreement, two months ahead of schedule, is sure to serve as the boilerplate for collective agreements contracts covering 3.4 million German workers in the metals and electronics sectors. 
 
Most profoundly, the new North Rhine-Westphalia pilot contracts guarantee job security until the middle of 2012 and establish a precedent-setting protocol against job redundancies as a lesson to this global economic crisis. 
 
The 25-month pair of agreements was crafted congenially in Dusseldorf between IG Metall and the employers&rsquo; federation in two sets of talks that concluded in the early hours of 18 February. One pact defers a wage increase until spring 2011, while the other assures no operational redundancies will occur before 30 June 2012. This agreement also sets new and far-reaching regulations on shortened work-time, including partial wage adjustments for short-term work and lowered costs for employers who utilize short-time work.

A key and unifying part of the job-security agreement, called the &ldquo;future in work&rdquo; pact, is a joint and vigorous call on the German government to extend crisis-fostered benefits beyond the end of this year for workers taking shorter work weeks. It also guarantees that shorter work weeks, from 35 to 28 hours with pay of 29.5 hours, will be an option, with that short-time work to be met with sickness, vacation, and Christmas benefits based on 12 months work. 
 
A 2.7% wage increase will take effect around April 2011, with Works Councils given the mandate to negotiate that sum within two months prior or two months after that date. Between May 2010 and March 2011, two single, one-off payments totaling &euro;320 per worker will be made. An important underlying element to the accord is that it allows employers to undertake the precise planning necessary to dig out of the crisis.

IG Metall President Berthold Huber termed the job protection provisions of the agreement &ldquo;a good result in securing jobs in the biggest economic crisis in 80 years.&rdquo; He added that the government must now do its part to supplement the agreement with extended social insurance benefits. And more precise to the German economy, the agreements serve as a bellwether statement that mass job losses weaken purchasing power far more than nominal wage increases do to spike buying power. 
 
The agreements not only will protect the jobs of hundreds of thousands of workers but equally, they assure that German enterprises will retain the skilled and seasoned staff in a sector so crucial to Germany&rsquo;s economy. 
 
By late last week, IG Metall and the metal, electronics employers were already tabling the accord in negotiations in Baden-W&uuml;rttemberg state. And this week the novel social contracts will come before the parties in Lower Saxony and Saxony-Anhalt, talks that take place in Hannover.

German Metalworkers, Employers Reach Historic Job Security Pact

Four French unions last week, 18 February, approved average wage increases for 60,000 EDF (Electricit&eacute; de France) workers of 4.4% for 2010. CFDT, CGT, CFTC, and CFE-CGC won workers a progressive and far-sighted wage accord that has a base salary increase, plus increases based on seniority, training, incentives, and promotions. 
 
The 80% state-owned EDF will see half of its workforce retire over the next ten years, with 45% of the company&rsquo;s nuclear workers alone set to retire by 2015. An industry-wide increase of 1.2% that was negotiated last November and took effect on 1 January is also factored into the 4.4% average boost in salaries. The agreement also includes individual incentives of up to 1.8%.

Over two-thirds of the 60,000 workers, those employed in distribution and high-voltage electric utility positions, will realize average wage packages increases of 4.2%. The agreement also prioritises training and career advancement opportunities, and likely will prevent the labour unrest within EDF that was characterized by several industrial actions in 2009. 
 
The CFDT termed the agreement satisfactory, while the CGT, which for the first time in many years joined the other unions in approving the results of this bargain, said the new agreement makes up some of the lost purchasing power of the recent past. 
 
The company characterized the wage agreement as &ldquo;not exorbitant&rdquo; and said it reflects the will of management to heighten social dialogue with the unions, particularly on job formation and skill upgrades. The positive global financial results posted by EDF in 2009 also contributed to the amiable wage negotiations, with the company stating that the various wage packages granted French workers should contribute to optimal operational performance in 2010. 
 
EDF is the world&rsquo;s largest operator of nuclear power plants, with some 17 plants and 58 reactors in France alone.

French Unions, EDF Agree to Positive 2010 Wage Terms

Last month, Bosnia-Herzegovina became the 24th country to ratify ILO Convention 176, the Safety and Health in Mines Convention. Passage by the Parliament and ratification by the President of the Balkan nation came along with adoption of nine other ILO Conventions, several of which relate to safety and health. 
 
An ILO official in Sarejevo, Lejla Tanovic, explained that the ratifications came after the ILO invited the government to submit all Conventions passed after 1993 to respective entities and social partners within the country for consultation in an effort to &ldquo;catch-up&rdquo; on approving social conventions following the war in the former Yugoslavia.

In 2008, the Council of Ministers at state levels inside Bosnia-Herzegovina did begin consultations on ten ILO Conventions and after their approval in 2009, the ten were passed on to the Parliament. Prior to Bosnia-Herzegovina, the last two countries to ratify Convention 176 were Peru and Luxembourg in 2008. 
 
First instituted in 1995, ratification of Convention 176 means that a national government will thoroughly and regularly inspect and investigate mining activity, and will assure that safe and reliable emergency procedures are put in place. It also allows that workers can freely and without prejudice notify authorities and management of unsafe conditions, and they have the right to leave a mining operation in the event of serious risk. 
 
Mining employers operating in a country that has ratified No. 176 must seek to eliminate all mining deaths and accidents by controlling and reducing inherent mining risks. They must provide the necessary equipment and communication systems to guarantee full security, and they must strive to preserve the land and the environment. As well, employers must assure the well-being of the communities and the people near their mining holdings.

The ten Conventions ratified in January 2010 by Bosnia-Herzegovina, besides Convention 176 are: Convention 94, the Labour Clauses (Public Contracts) Convention; Convention 174, the Prevention of Major Industrial Accidents Convention; Convention 175, the Part-Time Work Convention; Convention 177, the Home Work Convention; Convention 181, the Private Employment Agencies Convention; Convention 184, the Safety and Health in Agriculture Convention; Convention 186, the Seafarers&rsquo; Identity Documents Convention; the Maritime Labour Convention of 2006; and Convention 188, the Work in Fishing Convention. 
 
Besides the three above-mentioned countries, the other 21 nations to ratify ILO Convention 176 include: Albania, Armenia, Austria, Botswana, Brazil, Czech Republic, Finland, Germany, Ireland, Lebanon, Norway, Philippines, Poland, Portugal, Slovakia, South Africa, Spain, Sweden, United States, Zambia, and Zimbabwe.

Bosnia-Herzegovina Ratifies Safety, Health in Mines Convention 176

In this issue of the ICEM HIV/AIDS newsletter, we report on the results of the questionnaires on strength and weaknesses of the ICEM HIV/AIDS project; on treatment in earthquake devastated Haiti; and the call for union participation in the International AIDS Conference in Vienna, Austria, in July 2010.

ICEM affiliates are engaged in a wide range of HIV/AIDS activities. Annual Questionnaires Reveal Strength of ICEM HIV/AIDS Project 
 
Last year, the ICEM HIV/AIDS Project introduced year-end questionnaires in addition to the reporting of activities. The objective was to better assess the results compared to the objectives and to find out more about success stories and difficulties encountered in project implementation. 
 
The questionnaires show an increased focus not only on training of peer educators and counsellors but also their deployment in follow-up activities which reach more and more workers, their families, and the community. They also reveal more cooperation with employers, NGOs, and service providers. VCT campaigns in some countries were an overwhelming success, revealing how much can be done by unions when government agencies fail to respond. 
 
The introduction of a small budget allocation for material production was well accepted with the result that ICEM affiliates in the majority of project countries now have their own leaflets for use in awareness and prevention work. 
 
Difficulties encountered included the lack of time off granted by employers for peer educators to perform their duties and for meetings during working time; the lack of incentives for peer educators; the lack of resources to produce more campaign material and inadequate resources to cover more workplaces, especially in countries with a poor infrastructure and failing transport systems. 
 
What is still lacking, with a few exceptions, is the negotiation of HIV/AIDS workplace policies or collective bargaining agreements with HIV/AIDS clauses. In almost all countries, there is at least one employer with good practices on dealing with HIV/AIDS. Unions must become more active to build on good practices in their own country or in countries of a region to convince employers, who are lagging behind, to do more in the field of HIV/AIDS.

Global Union AIDS Programme Calls for Union Participation at the International AIDS Conference 
 
The Global Union AIDS Programme (GUAP) has called on Global Union Federations (GUFs) to sponsor unionists to participate in the International AIDS Conference (IAC), Vienna, Austria, 19 &ndash;23 July 2010. 
 
The last IAC took place in Mexico City in August 2008, and several GUF representatives attended the Conference, as well as the two-day Labour Forum. As a result of their participation and the efforts of ILO/AIDS, GUAP made significant progress in securing recognition of HIV/AIDS as a workplace issue and ensuring that the world of work was on the agenda. 
 
In Vienna, GUAP needs to do even better. The year 2010 is a significant year for the global HIV/AIDS response and for the world of work in particular. This year is the target year for the G8 commitment to achieving universal access to HIV prevention, treatment, and care made in 2005, and for achieving the second target of Millennium Development Goal 6, universal access to treatment. What is more, the new ILO instrument on HIV/AIDS in the world of work will be discussed and hopefully adopted at the International Labour Conference in June. The IAC will be an important forum to disseminate the instrument, explain its significance, and promote its use 
 
GUAP calls on GUFs to earmark funds to enable representatives to participate in the IAC so that labour&rsquo;s voice will be heard.

Combating AIDS through Workplace Action in Uganda 
 
TUC Aid &ndash; the development arm of the British trade union movement &ndash; is working in partnership with the National Organisation of Trade Unions (NOTU) in Uganda in a two-year workplace initiative to combat AIDS. The activities planned for the second half of 2009, under the Workers' AIDS Project (WAP) launched in July 2009, with a view to reducing stigma and discrimination associated with workers living with HIV/AIDS and negotiating for treatment, care, and support for such workers through collective bargaining arrangements with employers were successfully completed. 
 
The Project, funded by the Bill Morris Testimonial Fund for HIV/AIDS in Africa through TUC Aid, has contributed to greater awareness of risks of infection and of the potential for effective action through workplace.

Global Fund Ensures AIDS Treatment in Haiti 
 
As Haiti begins the process to rebuild the country after the devastating earthquake that hit on 12 January, the Global Fund to Fight AIDS, Tuberculosis and Malaria is focusing its effort to ensure that the thousands of people living with AIDS will be able to access the drugs they need to stay alive. 
 
Haiti has the highest HIV infection rate outside southern Africa, and 36,000 people are currently receiving antiretroviral treatment to stay healthy, 13,000 of these depend on programmes financed by the Global Fund. With many health centres destroyed and health workers killed, people moving away from their home areas and with transport difficult, there is an acute danger that many people will run out of the drugs they need. This would not only lead to many deaths, but the disruption of treatment would also lead to a high chance of drug resistance among those who stop and start their treatment. 
 
The Global Fund is making an emergency provision of US$800,000 for a supply of six months of stocks of antiretroviral medicines. The Global Fund is working closely with the U.S. President&rsquo;s Emergency Plan for AIDS Relief (PEPFAR), and UNAIDS to ensure an uninterrupted flow of life-saving AIDS medicines to these patients.

ILO Announces Strategy to Fight the Pandemic in Ghana 
 
Over a period of two years, the ILO/AIDS Workplace Programme will train about 195 senior officers from 20 trades associations on the removal of stigmatization and discrimination at the workplace, reaching out to more than 55,400 vulnerable people in the informal economy. In addition, 390 Peer Educators will be trained to assist some 100 companies with formulating and implementing HIV/AIDS workplace policies. The programme will also distribute two million condoms. 
 
Mrs. Akua Ofori-Asumadu, ILO/AIDS Workplace HIV National Programme Co-ordinator, announced this at the ILO/HIV and AIDS Programme Advisory Board meeting in Accra, which was attended by the Ministry of Employment and Social Welfare, Ghana AIDS Commission, Ghana Employers Association, Ghana Business Coalition against AIDS, and Ghana Trades Union Congress. 
 
She also said that the programme would develop kits and user guides necessary for workplace representatives to build comprehensive HIV/AIDS workplace programmes.

Lack of Resources Could Undermine HIV Response in Pakistan 
 
Pakistan&rsquo;s capacity to effectively respond to the HIV epidemic could be hindered due to the lack of resources to implement its National Strategic Framework. A priority is to address the increasing levels of HIV infections among injecting drug users (IDUs). 
 
Despite having an HIV prevalence rate of less than 0.1% among its general population, Pakistan&rsquo;s HIV epidemic has transitioned from low to a concentrated one, as the prevalence among IDUs has steadily increased from 10.8% in 2005 to nearly 21% in 2008. 
 
Following the model seen in other countries in Asia, also known as the Asian Epidemic Model, the epidemic in Pakistan is characterised by high prevalence among IDUs and potential spill-over into other risk populations such as commercial sex workers and men who have sex with men. 
 
Lack of financial resources and constraints in the health infrastructure could jeopardise an effective and timely response.

Spotlight on the Middle East and North Africa 
 
The HIV epidemic in the Middle East and North Africa (MENA) region, while seldom highlighted, is steadily growing. In 2008, there were an estimated 310,000 people living with HIV, up from 200,000 in 2001. Approximately 35,000 people became newly infected. 
 
Stigma and discrimination remain key barriers to an effective regional response. In many countries, the criminalisation of higher risk behaviours pushes affected communities, such as men who have sex with men, underground thereby limiting access to HIV prevention, treatment, and care and support services. 
 
UNAIDS works closely with government and civil society partners in the region to advocate the removal of punitive laws and policies that block an effective response.

Zimbabwe: HIV-positive People Want Constitutional Rights 
 
AIDS activists in Zimbabwe have launched a major drive to ensure that the rights of people living with HIV are enshrined in the new constitution. 
 
The Global Political Agreement, signed in September 2008 between Zimbabwe's political rivals, which gave rise to the coalition government in February 2009, includes writing the new constitution expected to be introduced in 2010. 
 
The Zimbabwe National Network of People Living with HIV and AIDS (ZNPP+) and the Southern Africa AIDS Information Dissemination Service (SAFAIDS), a regional non-profit AIDS organisation, call for a meaningful involvement of HIV-positive people in the constitution-making process. They note that the current constitution did not have any explicit reference to the right to healthcare and was &quot;silent on HIV.&rdquo; 
 
SAFAIDS and ZNNP+ are calling for a bill of rights that would promote better access to health services. The estimated two million people who are living with HIV and AIDS in Zimbabwe, one of the countries hardest hit by HIV/AIDS, have never before been actively involved in such legislation.

A Beginner&rsquo;s Guide to the Global Fund 
 
AIDSPAN recently published a beginner&rsquo;s guide to the Global Fund. The purpose of this guide is to provide a broad introduction to the Global Fund for people who have little or no prior experience of the Fund &ndash; ranging from new CCM members, to NGOs, to trade unions, to government officials, to new sub-recipients, to journalists who have to write about the Fund. This guide comes in three versions: the full guide (about 60 pages), an eight-page summary, and a two-page summary.

ICEM North American affiliate Power Workers Union (PWU) was one of several hosts for the 50th Canadian Nuclear Association&rsquo;s (CNA) annual meeting, held 24-26 February in Canada&rsquo;s capital city, Ottawa. The PWU is a proud promoter of Canada&rsquo;s nuclear power industry, and uses the forum to generate policy discussion with industry leaders, company officials, and human resource people. 
 
PWU also hosted several international guests, including guests from the CGT of France and AWU of Australia. PWU President Don MacKinnon also hosted former PWU President Kealy Cummings, a pioneer in Canada&rsquo;s nuclear sector and a former Canadian labour attach&eacute; to the UK, who was at many of the early CAN annual gatherings.

The Canadian Nuclear Workers&rsquo; Council was also represented at the forum, as was the ICEM. Some 700 people participated in the conference. The nuclear sector is a C$6.6 billion industry in Canada, employing 21,000 people directly, and responsible for another 40,000 indirect jobs. 
 
&ldquo;This conference has become much more than a typical annual industry gathering,&rdquo; said new CAN President and CEO Denise Carpenter. It has evolved into &ldquo;a fully integrated and interactive trade show, career fair, and education symposium.&rdquo;

Canadian PWU Involved in Nation’s Nuclear Sector

ICEM&rsquo;s three Italian affiliates, FILCEM&ndash;CGIL, FEMCA&ndash;CISL, UILCEM&ndash;UIL, are campaigning together against a recent decision by British multinational Glaxo Smith Kline to close its research centre in Verona, and put 550 employees out of work. 
 
A joint trade union delegation met four government ministers from the Ministries of Economic Development, and of Welfare and Health. The trade union leaders argued that the plant is profitable and also contributes to the profitability and growth of the company worldwide. Government Ministers were in agreement with the trade union arguments, and rejected the explanation of the company that the closure is part of the overall restructuring of the company.

The Italian Government Ministers Scaiola, Sacconi, Fazio, and Martini, have announced the establishing of an arbitration committee, which will seek to analyse in detail the reasons for Glaxo&rsquo;s decision to close its Verona facility, and hope to find a solution that will reverse their decision. The arbitration committee will be formed next month.

Italian Pharmaceutical Workers Protest Plant Closure, 550 Jobs Lost

The methane gas explosion on 23 February that killed 13 Turkish coal miners in northwest Balikesir Province could have prevented, according to the ICEM and its affiliate, Maden-Iş. The private mine, owned by Erhan Ortakoylu and his Şentaş Mining Company, had experienced a similar gas blast on 2 June 2006 killing 17 miners, and indications this time reveal that warning safeguards used to detect methane accumulation was inadequate. 
 
As well, it is suspected that a ventilation system failed to clear the deadly methane gas. 
 
The explosion injured 33 miners. Five of the 13 victims died in a hospital after rescue due to severe burns. The tragedy occurred 250 metres deep in the Odakoy mine, some 20 kilometres from the city of Dursunbey.

Maden-Iş stated that the mine had undergone insufficient safety audits. Even though the government claimed an audit had occurred in the weeks prior to the explosion, the union said that infractions detected were not corrected. Oftentimes in Turkey, safety audits of mines by the Labour and Social Security Ministry are not done on-site, but rather through queries to mine owners from afar. Nizamettin Tiryaki, a mining engineer for Maden-Iş, said that it is also not uncommon for mine inspectors to be paid off by private mine operators. 
 
The ICEM believes that expenditures on modern and efficient safety equipment by private miners are also sacrificed in order to maximize profits. At the time of the explosion, the ICEM, together with the ILO, was leading a symposium in Ankara on the necessity for Turkey to ratify ILO Convention 176, the Safety and Health in Mines Convention.

Gas Blast in Turkey, Killing 13, Needs Thorough Investigation

Swiss specialty chemical company Clariant has announced a further 400 job cuts at the Muttenz site, near Basel, as the company seeks to move production and increase profits. Clariant CEO, Hariolf Kottmann, oversaw the cutting of 137 jobs last year. Clariant turnover is around $8 billion and the company is a world leader in the supply of chemicals and colors for the textile, leather, paper, packaging, plastics, and printing. The proposed further job cuts will be made between now and 2012, as the company seeks to relocate production to Asia, where production costs are lower. 
 
The mass job cuts would be in breach of the collective agreement and of Swiss labour law. Workers are legally entitled to a period of consultation where alternative employment opportunities can be examined, before any jobs can be cut.

ICEM Swiss affiliate UNIA, together with the Clariant Workers Council, is pressing the company to first preserve these jobs, or at least provide acceptable redundancy packages. Demands include replacement jobs for every worker affected by the cuts, practical training and education programs, and no further cuts at the Schweizerhalle pharmaceuticals site. 
 
UNIA and the Clariant workers are organising a demonstration at Clariant headquarters on Thursday 11 March, starting at 5.15am. From there the demonstration will move to Liestal, meeting at the train station at 9am, before marching to the local government building &lsquo;Landratsgeb&auml;ude&rsquo; to call on district councilors to step in to preserve local jobs.

Swiss Chemical Workers Protest Job Cuts

The negotiations towards a new national collective agreement for the manufacturing industry in Denmark had been deadlocked, see ICEM report <a href="/en/78-ICEM-InBrief/3634-Danish-Contract-Negotiations-Deadlocked-on-National-Level">here</a>, but the renewal of the agreement was signed on Monday 22 February by the ICEM-affiliated general union, Central Organization of Industrial Employees in Denmark (CO-industri) and the Confederation of Danish Industry (DI). However the HK private trade union rejected the agreement. 
 
Gains for workers across the sector include two additional weeks for parental leave, improved redundancy pay, improved monitoring of health and safety for night-shift workers, improved working conditions for shift workers, and newly created authority on equal pay. 
 
The collective bargaining round directly affects 240,000 workers in the manufacturing industry. But it also indirectly affects an additional 350,000 workers in the private sector. As previously reported by ICEM, historically, the manufacturing agreement is used as a blueprint for other negotiations.

Both Hans Christensen, the negotiator for DI business, and Co-industri President Thorkild E. Jensen, were content with the renewed agreement, after negotiators worked through the night to beat a deadline which would have moved negotiations to a tribunal. Jensen described the agreement as &ldquo;balanced and guaranteed our members&rsquo; jobs&rdquo;. The agreement is valid for the period 1 March 2010 to 1 March 2012. 
 
Night workers were a priority for trade union negotiators in the talks, with free health exams provided every two years and for those employees who are advised against night work, their employer must find them another job. Night workers will also be eligible for up to ten extra days off annually. Changes to the rules on pension contributions will discourage employers from moving to precarious contracts. Apprentices see a 4.5% pay increase over the two years. 
 
The deal has been described as a &ldquo;crisis agreement&rdquo; and sees trade unions agreeing to only a small pay increase and for the first time since 1991, no increase in pension contributions.
